THE STORY

When Shewaye Girma Aboye travelled from Ethiopia to Lebanon in 2016 to work in the home of Ibrahim and Inaam Abou Haykal, she was only 14 years old. At such a young age, she was an easy target for exploitation. Shewaye worked not only in Inaam and Ibrahim’s house but also in the house of Inaam’s brother, Wasif.


Her salary for the three first months she worked was reportedly given to the Lebanese agent - Rima Services. This is an illegal, but common, practice in Lebanon. 


After not receiving her salary for many months, Shewaye asked to return back home. She told us that her employers would say

“How will you leave now if we have not paid you? Stay and work more and leave once we pay you.” 

When they finally bought her a ticket to go back home in October 2020, she had some hope that they would settle their debt to her. However,  they only gave her $100 at the airport.

Instead of boarding her plane, Shewaye decided to stay in Lebanon to fight for her rightful wages. Through the support of human rights organisations, Shewaye tried to confront her employers.


After waiting idly in Lebanon for 6.5 months, she was taken to General Security for an investigation where the employers were also present. When she was questioned alone, Shewaye said that she felt strong and empowered and recounted her story to the best she could in Arabic.

However, during the questioning with the employers, the latter showed the receipts of payment they had made (amounting to $2,200 out of a total owed of $8,400).  As a result, General Security’s decision favoured the employers. This Is Lebanon noted however that General Security failed to ask the employers  for proof of payment for the whole 4 years.


Shewaye was told she was lying and must immediately be sent back to Ethiopia; none of her evidence of voice notes from family and community members corroborating her story, were taken into consideration; neither was her financial log book where she kept track of payments received and missed (see image)

Shewaye returned to Ethiopia in May 2021. Since then, This Is Lebanon has attempted several times to negotiate with her employers. We have corroborated Shewaye’s version of the story with that of Inaam’s and Ibrahim’s family and community members, who stand in solidarity with Shewaye. Her employers have refused to pay the salary they owe.


When we asked Shewaye what she would like to say to her employers, she answered

“I have not lied. You are liars and exploiters. I have simply asked for my right, which you denied me. You are not going to pay me and I will have to come to terms with that, but my strength lies in God who knows everything. How would you feel if this happened to your children? Shame on you for what you did to me for all those years I served you.” 

Despite her difficult circumstances, Shewaye tried to fight for her rights. Under the kafala system however, it is almost impossible for Migrant Domestic Workers to access judicial redress. It is, after all, a system which former Labour Minister Camille Abousleiman likened to

“Modern-day Slavery.”

 حين سافرت "شيواي غيرما أبويه"، من أثيوبيا إلى لبنان عام 2016 لتعمل في منزل ابراهيم وإنعام أبو حايك، كانت في الرابعة عشر من عمرها، كانت هدفاً سهلاً للاستغلال. وقد عملت شيواي ليس فقط في منزل إنعام وابراهيم لكن أيضاً في منزل وصيف شقيق إنعام.

ورد أن راتبها عن الأشهر الثلاثة الأولى التي عملت فيها قد تم تسليمه للوكيلة اللبنانية - ريما للخدمات. وهذه ممارسة غير قانونية لكنها شائعة في لبنان.


وبناءً على شهادتها وشهادة أقارب وأصدقاء أصحاب العمل، والمعلومات التي تمت مراجعتها من قبل جمعية "هذا لبنان"، حصلت شيواي على مبلغ 2.200 دولار على مدار أربع سنوات من عملها مع عائلة أبو هيكل. كان من المفترض أن تحصل شيواي على 8400 دولار ما يعني أنهم مدينون لها بمبلغ 6.200 دولار عن 3 سنوات من العمل غير المأجور.


بعد عدم استلامها لراتبها عدة أشهر، طلبت شيواي العودة إلى بلدها. أخبرتنا أن أصحاب العمل كانوا يقولون:

"كيف ستغادرين الآن إن لم ندفع لك؟ ابقي واعملي أكثر وارحلي بمجرد أن ندفع لك".

وحين اشتروا لها أخيراً تذكرة للعودة إلى الوطن في تشرين الأول 2020، كان لديها بعض الأمل في تسوية ديونهم لها. ومع ذلك، لم يعطوها سوى 100 دولار فقط في المطار.

وبدلاً من الصعود على متن طائرتها، قررت شيواي البقاء في لبنان للنضال من أجل الحصول على أجرها المستحق. وبدعم من منظمات حقوق الإنسان، حاولت شيواي مواجهة أصحاب العمل.


بعد انتظارها في لبنان لمدة 6 أشهر ونصف دون أن تحرك ساكناً، تم اصطحابها إلى الأمن العام لإجراء تحقيق حيث كان أصحاب العمل حاضرين أيضاً. وحين تم استجوابها على انفراد، شعرت شيواي بأنها قوية ومتمكنة وسردت قصتها بأفضل ما يمكنها باللغة العربية.

ومع ذلك، أثناء الاستجواب مع أصحاب العمل، أبرزوا إيصالات الدفع الذي قاموا به (تصل إلى 2.200 دولار من إجمالي الديون المستحقة البالغ 8.400 دولار). ونتيجة لذلك، كان قرار الأمن العام في صالح أصحاب العمل. لكن جمعية "هذا لبنان" أشارت إلى أن الأمن العام لم يطلب  إثبات الدفع عن كامل السنوات الأربع من قبل أصحاب العمل.


وقد أخبروا شيواي بأنها تكذب ويجب إعادتها إلى إثيوبيا على الفور؛ لم يؤخذ في الاعتبار أي من إثباتاتها كالرسائل الصوتية من الأسرة وأفراد المجتمع التي تدعم قصتها أو إن كان دفتر السجل المالي الخاص بها حيث كانت تحتفظ بالمدفوعات المستلمة وغير المستلمة. (انظر الصورة).

عادت شيواي إلى إثيوبيا في أيار 2021. ومنذ ذلك الحين، حاولت جمعية "هذا لبنان" عدة مرات التفاوض مع أصحاب العمل. وقد أيدنا رواية شيواي للقصة برواية عائلة إنعام وابراهيم وأفراد المجتمع المتضامنين مع شيواي. رفض أصحاب العمل دفع الراتب المستحق عليهم.

عندما سألنا شيواي عما تود أن تقوله لأصحاب العمل، أجابت:

" أنا لم أكذب. أنتم كاذبون ومستغلون. لقد طلبت حقي ببساطة، وهو ما حرمتموني منه. لن تدفعوا لي وسأتقبل ذلك، لكن قوتي تكمن في الله العارف كل شيء. كيف سيكون شعوركم إن حدث هذا لأطفالكم؟ عار عليكم لما فعلتموه بي طوال تلك السنوات التي خدمتكم فيها."

على الرغم من ظروفها الصعبة، حاولت شيواي النضال من أجل حقوقها. لكن في ظل نظام "كفالة"، يكاد يكون من المستحيل لعاملات المنازل الوافدات الحصول على الإنصاف القضائي. في النهاية، إنه نظام شبهه وزير العمل السابق كميل أبو سليمان بـ

 "عبودية العصر الحديث".
