Bechara and Cynthia Khairallah Defraud Their Long-Serving Worker
Cynthia said she'd pay Eyah at the end of her contract. She "gave her a handful of dollars at the airport". Turns out that handful was $3452 short.

THE STORY
It is easy to assume that if a worker has been with the same employer for a long time, everything is going well. That definitely was not the case for Emmaculate Fondum Eyah, a Cameroonian woman, who came in 2013 to work for Cynthia and Bechara Khairallah, only to be sent home 7 years later with 50% of her salary. A seven-year relationship was no guarantee for Eyah that she would receive her rights, nor was it a guarantee that the employers would fulfill their responsibilities.
The same day that Eyah safely arrived back home, she contacted This is Lebanon for help. Eyah had not been paid since 2017 and when she was packing her bags to go back to Cameroon for good, Cynthia showed no signs of paying her. It was not until Eyah got to the airport that Cynthia gave her a wad of cash, which Eyah had to quickly tuck away, for obvious security reasons. Clearly, Cynthia thought giving three years worth of salary - 7,452 USD - at a public place, in an airport, was acceptable and justified.
To Eyah’s surprise, her employer only paid 4,000 USD, about 50% of what was owed to her, but there was little she could do, considering she was already at the airport and had a plane to catch, not to mention that her employer had already left. This is why she contacted us as soon as she arrived to Cameroon.
When our case negotiator contacted Cynthia to understand her point of view, Cythnia explained at great length what a bad worker Eyah was and how she drove other workers away, and in contrast, how she was great with the worker and always bought her clothes, bags and perfumes.
But when the time came to discuss what really mattered to Eyah, the issue of non-payment of her salary, Cynthia turned defensive and aggressive.
When the negotiator asked the employer how much she paid Eyah, she said she couldn’t remember.

“I gave her a handful of dollars. Maybe it was $9,000. Maybe it was $10,000. I don’t know.”
We found it highly implausible that an employer who paid thousands of dollars couldn’t remember how many thousands. When she was asked for receipts, she said she’d thrown them out.
The negotiator asked Cynthia how she saw fit to pay such a large sum of salary at the airport, without giving Eyah an opportunity to count her money in an appropriate environment. Cynthia initially denied paying three years of wages at the airport, scoffing at the accusation. She said, “I gave her the money before she left the house. We packed her stuff and I gave her her money and we left.”
Later in the same conversation, she changed her story saying she actually gave her the money in the car on the way to the airport. Only at the end of the conversation, did she admit to paying it in haste, at the airport.
Cynthia could not make up her mind where she gave her the money. We find it strange that someone who supposedly handed over about $10,000 in cash couldn’t remember where that took place. According to Cynthia, the airport was the best place to pay three years worth of salaries, and Eyah could have easily complained to a police officer about the alleged underpayment, even if that meant missing her flight.

We strongly believe that is unacceptable. There is only one way to pay salaries and that is according to the labour contract signed at the notary public. Article six of that contract states that the worker should be paid in full every month. Ms. Cynthia and Mr. Bechara Khairallah severely breached the contract. According to Eyah, “madam Cynthia is the one who wanted to keep my money and she promised to pay me all my money when am done with my contract.”
Eyah is still owed 3,452 USD and Cynthia has refused to pay. Cynthia has a new domestic worker. We don’t know if she is being paid or not.
Eyah explains she wants the world to know what happened to her and says:
“She gave perfume, a watch, chains and some nice dresses and shoes as a gift but when I told her that I want to go to my country she was very upset and promised to teach me a lesson. I believe the best lesson she promised to teach me was not paying all my money and taking back some of the items she gave me”

في اليوم نفسه الذي عادت فيه "إياه" إلى وطنها سالمة، اتصلت بـجمعية "هذا لبنان" طلباً للمساعدة. لم تقبض"إياه" أجرها منذ عام 2017، وحين كانت تحزم حقائبها لتعود نهائياً إلى الكاميرون، لم تُظهر سينثيا أية علامة تدل على أنها ستدفع لها، إلى أن وصلت "إياه" إلى المطار فأعطتها سينثيا مبلغاً نقدياً، كان على "إياه" أن تدسّه بحقيبتها وتخفيه سريعاً، لأسباب أمنية بديهية. من الواضح أن سينثيا ظنّت أن إعطاء رواتب ثلاث سنوات - 7،452 دولاراً أمريكياً - في مكان عام، في أحد المطارات، هو أمر مقبول ويمكن تبريره.
ومما أدهش "إياه"، أن صاحبة العمل قد دفعت لها 4000 دولار أمريكي فقط، أي حوالي 50 بالمئة من مستحقاتها المالية، إلا أنه لم يكن بإمكانها فعل الكثير، مع الأخذ بعين الاعتبار أنها كانت أصلاً في المطار وعليها أن تلحق بطائرتها، ناهيك عن أن صاحبة العمل كانت قد غادرت. ولذلك اتصلت بنا بمجرد وصولها إلى الكاميرون.
عندما تواصل مفاوضنا مع سينثيا لنفهم وجهة نظرها، شرحت سيثنيا بإسهاب كم كانت "إياه" سيئة وكيف أبعدت عاملات أخريات، وفي المقابل كم كانت هي رائعة مع العاملة، واشترت لها دائماً العطور والملابس والحقائب. ولكن عندما حان الوقت لمناقشة ما يهم "إياه" حقاً، أي قضية عدم دفع راتبها، أصبحت سينثيا دفاعية وعدوانية.
وحين سأل المفاوض صاحبة العمل عن المبلغ الذي دفعته ل"إياه"، قالت إنها لا تذكر.

"أعطيتها حفنة من الدولارات. ربما كانوا 9000 دولار. وربما 10000 دولار. لا أعلم."
نرى أنه من غير المعقول للغاية أن صاحبة العمل التي دفعت آلاف الدولارات لا يمكنها تذكر عددها. ولما طُلب منها إيصالات، قالت بأنها قد تخلصت منها.
سأل المفاوض سينثيا كيف ترى أنه من المناسب دفع مثل هذا المبلغ الكبير من الراتب في المطار، دون إعطاء فرصة ل "إياه" أن تعدّ نقودها في ظروف مناسبة. أنكرت سينثيا في البداية دفع أجور ثلاث سنوات في المطار، مستهزئة بهذا الاتهام. وقالت: "لقد أعطيتها النقود قبل أن تغادر المنزل. وضّبنا أغراضها وأعطيتها المال وغادرنا".
في وقت لاحق من المحادثة نفسها، غيرت روايتها قائلة بأنها بالفعل أعطتها المال في السيارة في طريقها إلى المطار.
فقط في نهاية المحادثة، اعترفت بالدفع لها على عجل في المطار. بإمكانكم الاستماع إليها وهي تقول ذلك هنا. لم تستطع سينثيا أن تقرر أين أعطتها المال. نرى أنه من الغريب أن شخصاً يُفترض أنه سلّم ما يقارب 10000 دولار نقداً لا يمكنه تذكر مكان حدوث ذلك.

كان المطار، بالنسبة لسينثيا، المكان الأفضل لدفع رواتب ثلاث سنوات، وكان بإمكان "إياه" بسهولة أن تشتكي إلى ضابط شرطة من النقص المزعوم للمبلغ، حتى لو كان ذلك يعني عدم اللحاق برحلتها.
لدينا إيمان راسخ بأن هذا غير مقبول. فهناك طريقة واحدة فقط لدفع الرواتب وذلك حسب عقد العمل الموقع لدى كاتب العدل. تنص المادة السادسة من هذا العقد على أن العاملة يجب أن تتقاضى أجرها بالكامل كل شهر. والسيدة سينثيا والسيد بشارة خير الله خرقا العقد بشدة. وفقاً ل"إياه"، "سيدتي سينثيا هي التي أرادت الاحتفاظ بأموالي ووعدت بدفع كل نقودي عند انتهاء عقدي."
لم تقبض "إياه" مستحقاتها المالية 3،452 دولاراً أمريكياً، وقد رفضت سينثيا أن تدفع. سينثيا لديها عاملة منزلية جديدة. لا نعرف ما إذا كانت تتقاضى أجراً أم لا.
أوضحت "إياه" أنها تريد أن يعرف العالم ما حدث لها وتقول:
"لقد قدّمت لي عطراً وساعة وسلاسل وبعض الفساتين والأحذية الجميلة كهدية، لكن عندما أخبرتها أنني أريد الذهاب إلى بلدي، انزعجت جداً ووعدت أن تلقّنني درساً. أعتقد بأن أفضل درس وعدتني بتعليمي إياه هو عدم دفع كل أموالي واسترداد بعض الأشياء التي قدمتها لي."
